A youngster was run over in Scarborough, and the driver of a garbage truck in Perth was fined $2500 and prohibited from driving for three months.
For John Fogarty, the father of the boy, the sentence was insufficient.
Fogarty said, “My son has been recovering for longer than that,” outside of court today.
Jackson Fogarty is currently undergoing rehabilitation following an accident that fractured his leg, wounded his neck, and terrified the small child.
In November, the four-year-old was running along Deanmore Road when the garbage truck pulling out of a laneway ran him over.
The driver, David Ross Williams, acknowledged driving recklessly.
A magistrate declared that although the event was frightening and upsetting, it was ultimately an accident.
Fogarty remarked of the driver, “He’s going to have to look at himself every day knowing that’s what he’s done.”
Fogarty is currently thinking about suing Veolia, the waste management business, claiming that it takes traffic safety very seriously.
In addition, the father is battling Stirling Council once more.
The municipality has placed safety markings along the pathway to warn users to stop and look after the accident, but Fogarty says he won’t give up on getting the laneway blocked.
Although it is privately held, the city is thinking about buying it.
“It passes right adjacent to an elementary school.
It’s plain sense to establish an atmosphere that prevents this from happening again because it’s a dirt laneway,” he stated.
